What are tenant rights in Portugal?

If you have finally found a property for rent, there are a couple of things that you need to know about your rights as a tenant in Portugal.

Law 12/2019 grants tenant protection from the harassment of the landlord during the lease and sublease. In other words, this law protects the tenant from being disturbed or harassed by the landlord or a third party that wants to acquire the property.

When such a situation occurs, the landlord has 30 days to solve it. Otherwise, the landlord must pay 20€ penalty each day after the 30-day notice from the tenant until the problem is solved.

Law 13/2019 decreases the mandatory additional compensation to the landlord when the tenant does not pay his rent from 50% to 20%.

Furthermore, with the new regulations in the rental laws, a tenant with a missing written contract can still prove the existence of a contract by demonstrating that he is using the property without the landlord opposition and showing proof of payment of at least six months’ rent.
