For residence and temporary-stay visas, AIMA (and the UCFE) must first issue a mandatory prior opinion, including a migratory-risk analysis — but the visa decision itself is the consul’s. Verbatim (Art. 48.º n.º 1 al. b): competent to grant visas are "Os postos consulares de carreira e as secções consulares, nos restantes casos." Verbatim (Art. 53.º n.º 1): "A concessão de visto carece de parecer prévio obrigatório da AIMA, I. P., e da UCFE… a) Quando sejam solicitados vistos de residência e de estada temporária…" (n.º 3: AIMA does the "análise de risco migratório"). The residence permit is decided by AIMA afterwards (visa-general-decision).
